1. Acceptance of Terms

By accessing and using the ThermaBuild website and Home Planner (the "Service"), provided by Alexander Construction, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

2. Description of Service

ThermaBuild provides information about our high-performance home designs and a Home Planner tool that lets you explore designs, select inclusions, and request a consultation. The Service is provided "as is" and "as available".

3. Indicative Pricing Only

All pricing displayed on the Service — including base design prices, inclusion options, totals shown in the Home Planner, and any saved designs — is indicative only. Final pricing is subject to:

• your specific building location and site conditions (including access, ground conditions, services, and council requirements);
• the final design developed for you;
• your final selections, specifications and any variations;
• market conditions at the time of contract, including material and labour costs.

No information on the Service constitutes a quote, offer, or contract. A fixed price will only be provided in a formal written building contract signed by Alexander Construction.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information during registration and to keep it up to date.

5. Acceptable Use

You agree not to misuse the Service, including attempting to gain unauthorised access, transmitting harmful content, or using the Service for unlawful purposes.

6. Intellectual Property

All content, designs, branding, imagery, and software associated with ThermaBuild and Alexander Construction are our property or used under licence. You retain ownership of the information you submit to the Service.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law, Alexander Construction shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Service or any reliance on indicative pricing or information presented on the Service.

8. Termination

We reserve the right to suspend or terminate your account if you breach these terms. You may delete your account at any time by contacting us.

9. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
